This paper analyzes resource utilization of the Sundarbans in terms of the contradictory issues and pressures generated by foreign assistance and commercial interests in Bangladesh. In the paper, the historical legacy of resource definition and use that shaped the development of forest policy under the British is considered. In addition, the critical role of the state and the interests and pressures on the Government are explored as these shape the larger context in which current natural resource policy is generated and (...) maintained. Three areas of potential conflict between current devlopment policy and resource management control are noted. They are 1) the privatization of production and resource exploitation in contrast to common property resource use, 2) the need to meet foreign exchange requirements versus local user interests, and 3) commercial versus local user interests.The paper argues that national and international fiscal and economic constraints operate to favor commercial interests and natural resource exports at the cost of policies that emphasize an active approach to the generation and preservation of renewable resources such as the Sundarbans. Within an ethical context, our model is concerned with the client misreporting and its detection by the auditor. The paper uses a welfare game(similar to the game of chicken) to more formally model client-auditor strategies. The welfare game is then extended to provide additional insight into ethical and audit effort issues.Such a welfare gameprovides equilibrium in mixed strategies. This mixed strategy solution makes (...) possible four outcomes from the game: 1) Financial Statements are fairly presented by client and the auditor performs a normal audit, 2) Financial Statements are fairly presented by client and the auditor performs an extended audit (over auditing), 3) Financial State-ments are misstated by client and detected by the auditor, and 4) Financial Statements are misstated by client and not detected by the auditor (audit failure despite no intended unethical action on the part of the auditor). Language’s intentional nature has been highlighted as a crucial feature distinguishing it from other communication systems. Specifically, language is often thought to depend on highly structured intentional action and mutual mindreading by a communicator and recipient. Whilst similar abilities in animals can shed light on the evolution of intentionality, they remain challenging to detect unambiguously. We revisit animal intentional communication and suggest that progress in identifying analogous capacities has been complicated by (i) the assumption that intentional (that is, voluntary) production (...) of communicative acts requires mental-state attribution, and (ii) variation in approaches investigating communication across sensory modalities. To move forward, we argue that a framework fusing research across modalities and species is required. We structure intentional communication into a series of requirements, each of which can be operationalised, investigated empirically, and must be met for purposive, intentionally communicative acts to be demonstrated. Our unified approach helps elucidate the distribution of animal intentional communication and subsequently serves to clarify what is meant by attributions of intentional communication in animals and humans. Appels au meurtre et à la haine, apologie de la pédophilie, propos racistes ou sexistes, quelles sont les limites de la liberté d'expression en littérature ? Le style et la fiction autorisent-ils toutes les transgressions ?

During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the neonate cannot (...) express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. Scholars have noted persistent high rates of agricultural health and safety incidents and the need to develop more effective interventions. Participatory research provides an avenue to broaden the prevailing research paradigms and approaches by allowing those most impacted to illuminate and work to solve those aspects of their lives. One such approach is photovoice, an emancipatory visual narrative approach. Yet, despite its broad appeal, photovoice can be hard to implement. In this article, we leverage our experience using photovoice for a (...) farm children safety project to describe and reflect on the ethical and methodological aspects broadly relevant to agricultural health and safety topics. We first contextualize the tensions of navigating between photovoice, the research ethics committees (RECs) regulatory frameworks, and competing views on visual representations in agriculture. We then discuss the sources of risks to participants and researchers, how we addressed these risks, and how these risks unfolded during the research phase of the photovoice activity. We conclude with three lessons we (re)learned: the importance of collaborating with RECs, the need to increase preparation to limit psychological risks to participants and researchers, and avenues to augment the emancipatory power of photovoice in a virtual environment. Le problème historique majeur posé par l’étude de la prostitution à Rome est celui de l’existence de prostitué(e)s libres dans une société esclavagiste. Puisque des corps serviles, ou affranchis, masculins et féminins étaient disponibles en grand nombre, aussi bien dans les demeures des hommes libres que dans les maisons de prostitution, comment se fait-il que des femmes nées libres aient renoncé à leurs privilèges et statut de matrones? Comment se fait-il aussi que la société ait institutionnalisé ce renoncement en prévoyant (...) d’enregistrer officiellement ces prostituées d’origine libre? L’explication proposée ici est que les prostitué(e)s libres assument une fonction symbolique qui est d’être l’autre du soldat comme l’acteur est l’autre de l’orateur. Ces « parias » de la société romaine, toujours « efféminés » servent à marquer les marges de l’humanité civilisée dans la continuité, à définir les hommes, libres et adultes et donc « masculins » par ce qu’ils ne sont pas mais ce qu’ils pourraient par malheur, devenir des « effeminés » ou leur équivalent, des prostituées libres. This contribution investigates the use of the Czech particle jako in naturally occurring conversations. Inspired by interactional research on unfinished or suspended utterances and on turn-final conjunctions and particles, the analysis aims to trace the possible development of jako from conjunction to a tag-like particle that can be exploited for mobilizing affiliative responses. Traditionally, jako has been described as conjunction used for comparing two elements or for providing a specification of a first element [“X like Y”]. In spoken Czech, however, (...) jako can be flexibly positioned within a speaking turn and does not seem to operate as a coordinating or hypotactic conjunction. As a result, prior studies have described jako as a polyfunctional particle. This article will try to shed light on the meaning of jako in spoken discourse by focusing on its apparent fuzzy or “filler” uses, i.e., when it is found in a mid-turn position in multi-unit turns and in the immediate vicinity of hesitations, pauses, and turn suspensions. Based on examples from mundane, video-recorded conversations and on a sequential and multimodal approach to social interaction, the analyses will first show that jako frequently frames discursive objects that co-participants should respond to. By using jako before a pause and concurrently adopting specific embodied displays, participants can more explicitly seek to mobilize responsive action. Moreover, as jako tends to cluster in multi-unit turns involving the formulation of subjective experience or stance, it can be shown to be specifically designed for mobilizing affiliative responses. Finally, it will be argued that the potential of jako to open up interactive turn spaces can be linked to the fundamental comparative semantics of the original conjunction. (shrink)

Comment est né l'Etat moderne que d'aucuns disent en crise? Quel rôle a-t-il joué dans la relative pacification des sociétés occidentales au cours des cinq derniers siècles? Une théorie de la civilisation peut-elle comprendre et expliquer Auschwitz? L'œuvre de Norbert Elias s'est confrontée sans faux-semblants aux principaux défis légués par le XXe siècle aux sciences humaines. Atypique et longtemps méconnue, cette sociologie historique assume la tentative de penser ensemble, et dans la longue durée, l'évolution des structures psychiques des individus et (...) celle des structures sociales des entités qu'ils forment. Aujourd'hui, les conséquences de la mondialisation et les questions soulevées par l'intégration européenne lui offrent une actualité nouvelle. Les transformations affectant l'organisation politique des hommes n'ont certes aucune raison de s'arrêter aux frontières des Etats-nations, peut-être appelés à disparaître sous l'effet d'interdépendances devenues planétaires. Mais quand l'appartenance à l'humanité peine à créer du sens, peut-on éviter que la communauté ne se fonde sur un sentiment, par définition toujours exclusif d'un " autre "? La tâche du sociologue se voit alors redéfinie : mettre les problèmes en histoire afin de les mettre à distance. De même que sa mission : rapprocher les individus en leur faisant connaître et reconnaître les liens qui les unissent. C'est à la lumière de cette double ambition que se laisse décrypter la réflexion d'Elias. Une réflexion sur le devenir de la civilisation et de l'Etat aussi originale que contestée, et dont les enjeux politiques et épistémologiques ne sauraient être dissociés. (shrink)

Informal science learning sites create opportunities for children to learn about science outside of the classroom. This study analyzed children’s learning behaviors in ISLS using video recordings of family visits to a zoo, children’s museum, or aquarium. Furthermore, parent behaviors, features of the exhibits and the presence of an educator were also examined in relation to children’s behaviors. Participants included 63 children and 44 parents in 31 family groups. Results showed that parents’ science questions and explanations were positively related to (...) children observing the exhibit. Parents’ science explanations were also negatively related to children’s science explanations. Furthermore, children were more likely to provide science explanations when the exhibit was not interactive. Lastly there were no differences in children’s behaviors based on whether an educator was present at the exhibit. This study provides further evidence that children’s interactions with others and their environment are important for children’s learning behaviors. (shrink)

La contractualisation du vivant, tous règnes confondus, est aujourd'hui une réalité incontestable. Puisant ses racines dans la révolution scientifico-technique qui a constitué le vivant en réservoir de ressources biologiques exploitées à des fins diverses, le phénomène se matérialise par un foisonnement d'opérations dont le contrat est le maillon emblématique. Fondé sur l'analyse d'un corpus de quelque 120 contrats, l'ouvrage présente cette évolution selon une triple entrée. Une première partie brosse le contexte dans lequel se déploie la chaîne du vivant. Dans (...) une deuxième partie, les contrats sont analysés pour eux-mêmes, de façon technique. La troisième partie propose d'appréhender la contractualisation du vivant en termes de politique juridique. Trois constats ressortent de cette analyse. D'une part, la contractualisation contribue à uniformiser le vivant : il apparaît que par le prisme du contrat, les ressources biologiques végétales, animales et humaines sont, mutatis mutandis, l'objet d'opérations très similaires. D'autre part, et contre toute attente, les opérations scandant la circulation des ressources biologiques se coulent pour la plupart dans les catégories du droit des contrats, en dépit de l'irréductible spécificité de l'objet matériel, qui contraint souvent les parties à faire preuve d'inventivité dans l'élaboration de stipulations contractuelles adaptées à leurs besoins. Enfin, si originalité il y a, elle se manifeste tout particulièrement quand il s'agit de déterminer les enjeux de la contractualisation en termes de politique juridique, spécialement dans un domaine fortement empreint d'intérêt général. A cet égard, même si la loi demeure, à l'évidence, le cadre de référence obligé de la circulation des ressources biologiques, le contrat en apparaît comme un indispensable relais. (shrink)

Transgender conversion practices involve attempts to alter, discourage, or suppress a person’s gender identity and/or desired gender presentation, including by delaying or preventing gender transition. Proponents of the practices have argued that they should be allowed until proven to be harmful. Drawing on the notion of expressive equality, I argue that conversion practices are prima facie unethical because they do not fulfill a legitimate clinical purpose and conflict with the self-understanding of trans communities.

Control over food supply was advanced in the kingdom of France in the Eighteenth century by Physiocrat economists under the seemingly advantageous label of 'freedom of grain trade'. In 1764 these reforms brought about a rise in grain prices and generated an artificial dearth that ruined the poor, some of whom died from malnutrition. The King halted the reform and re-established the old regime of regulated prices; in order to maintain the delicate balance between prices and wages, the monarchy tried (...) to limit speculation in subsistence goods and achieved some success in regulating the provisioning of public markets. Le Mercier de la Riviere concluded that executing these reforms required more effective political control. After 1774 the new king gave the Physiocratic reforms a second chance, reforming property rights and establishing an aristocracy of the landed rich. Again, this led to price hikes and as a result so-called 'popular emotions' erupted. Turgot ordered military intervention to dispel the protesters, marking a first rupture between the monarchy and the people over speculation on subsistence. Turgot's experiment failed and he was dismissed, but the Physiocracy had discovered that the market in subsistence offered new opportunities for economic power under the misleading legitimacy of 'economic laws'. Turgot's followers, Dupont de Nemours and Condorcet, continued to develop this 'theory' that was later translated into a 'scientific language' that ultimately asserted the autonomy of the economic sphere and its alleged independence from ethics and politics. The paper examines the continuity of events through the six great jacqueries and the French Revolution, including the all- important agrarian reform that ensued after 1792. Robespierre's concept of 'popular political economy' is analysed and compared with the notion of unfettered private property rights that lies at the heart of neoliberalism. (shrink)

L’étoffe de tissu en raison de sa qualité (texture, couleur, richesse) et de son agencement est un prolongement du corps et un marqueur visible d’identité. L’article s’interroge dès lors sur les valeurs attachées aux costumes féminins en fonction de l’âge, des contextes (domestique, érotique, rituel, politique) et du rang dans la société, sur les (...) façons dont ceux-ci qualifient les femmes et leurs comportements, et disent finalement la condition féminine comme masculine dans le discours poétique, au théâtre, chez les historiens, dans les lois cultuelles et en images. Le vêtement propose un discours sur soi, sur l’autre, et est source de discours. Doté d’un pouvoir agissant, il énonce aussi bien le kosmos, ornement et ordre, autrement dit la beauté des femmes et du monde, l’eukosmia, que le désordre et le chaos politiques dans les cités grecques durant l’Antiquité. Increasingly in certain circles the idea is growing up that ‘intellectual property is theft’. With companies being concentrated into multimedia groups, literary works being captured electronically, products being created for a mass-media culture, commercial exchange on a worldwide scale, the legitimacy of the creator's literary and artistic property is being challenged. Originally the ‘droit d'auteur’ or copyright were mainly protective rules laid down by law to regulate the author's status. The legal system of literary and artistic ownership still ensures that (...) creators receive revenue each time their works are reproduced, adapted or communicated to the public. In addition the droit d'auteur has another aspect through the existence of moral right, which establishes a personal link between author and work. It is true that moral right, which is sometimes seen as an obstacle to economic development, is almost non-existent in the systems of law recognizing copyright, which do not incorporate the same balance of interests as between the author and the company. On the other hand, in its formulation the droit d'auteur takes a more human approach and to say that intellectual property is theft would be equivalent to weakening, or even eradicating, a system that protects individual creators facing the reality of the exploitation of their work. This is why this criticism of legitimacy should, in my view, be considered in the context of a debate about the status of the author. Interest in science and math plays an important role in encouraging STEM motivation and career aspirations. This interest decreases for girls between late childhood and adolescence. Relatedly, positive mentoring experiences with female teachers can protect girls against losing interest. The present study examines whether visitors to informal science learning sites differ in their expressed science and math interest, as well as their science and math stereotypes following an interaction with either a male or female educator. Participants were visitors to one (...) of four ISLS in the United States and United Kingdom. Following an interaction with a male or female educator, they reported their math and science interest and responded to math and science gender stereotype measures. Female participants reported greater interest in math following an interaction with a female educator, compared to when they interacted with a male educator. In turn, female participants who interacted with a female educator were less likely to report male-biased math gender stereotypes. Self-reported science interest did not differ as a function of educator gender. Together these findings suggest that, when aiming to encourage STEM interest and challenge gender stereotypes in informal settings, we must consider the importance of the gender of educators and learners. The aim of the present research was twofold. First, we examined the effects of perceived organizational support on workplace conflict (i.e., relationship conflict and task conflict). Second, we identified one mechanism explaining these relationships, namely failure-related trust. Using a sample of 263 teachers from Belgium, the results of Study 1 indicated that perceived organizational support is negatively related to relationship conflict and is also, unexpectedly, negatively related to task conflict. Furthermore, using a sample of 477 Belgian employees, Study 2 replicated (...) these results and further demonstrated that failure-related trust mediates the negative relationship between perceived organizational support and both types of workplace conflict. Lacker (1981) and Lacker & Akin (1988) developed a mathematical model of follicular maturation and ovulation; this model of only four parameters accounts for a large number of results obtained over the past decade or more on the control of follicular growth and ovulation in mammals. It establishes a single law of maturation for each follicle which describes the interactions between growing follicles. The function put forward is sufficient to explain the constancy of the number of ovulations or large follicles (...) in a female as well as the variability of this number among strains or species and for either induced or spontaneous ovulators. According to the model, the number of ovulations or large follicles lies between two limits that are themselves simple functions of two parameters of the model. Moreover, Lacker's model exhibits interesting characteristics in agreement with results obtained by physiologists: in particular, it predicts that the number of ovulating or large follicles is independent of:1. the total number of maturing follicles, 2. the process of recruitment of newly maturing follicles towards the terminal maturation (Poisson or other), 3. the form of the LH or FSH secretion curves as functions of the systemic level of oestradiol. The model further predicts that 4. selection and dominance of follicles result from the feedback between the ovary and the hypophysis through the interactions between follicles; these interactions are expressed by the maturation function of the model. 5. recovery from atresia is possible for a follicle: from decreasing, the rate of secretion of oestradiol may increase. 6. the revised model suggests a renewal of follicles during the sexual cycle, as waves of follicular growth. Lacker's model is a model of strict dominance; it maintains a hierarchy of the follicles as soon as they start their final maturation to the ovulations as that is observed in bird or reptile ovary. Such a strict hierarchy is possible but it is probably not a general situation in all mammals. We therefore modified the maturing function of the follicle in order to make it compatible with the observations of physiologists: follicles always interact as in the initial model but they individually become old, the hierarchy of follicles can be modified with time and the largest follicles do not indefinitely grow as in the initial model. Hume's famous discussion of miracles in the Enquiry Concerning Human Understanding is curious both on account of the arguments he does deploy and on account of the arguments he does not deploy, but might have been expected to. The first and second parts of this paper will be devoted to examining, respectively, these two objects of curiosity. The second part I regard as the more important, because I shall there try to show that the fact that Hume does not deploy (...) an argument that he might have been expected to deploy in fact reflects a weakness in the view of natural laws that has come to be associated with Hume's name. I shall argue, in fact, that it is a symptom of the defectiveness of the ‘Humean’ view of natural laws that on that view it is only too easy to rule out the possibility of a miracle ever occurring. In the third part of the paper, I shall show how another view of laws can overcome this problem. (shrink)

The right not to know is underappreciated in policy-making. Despite its articulation in medical law and ethics, policy-makers too easily let other concerns override the right not to know. This observation is triggered by a recent decision of the Dutch government on embryo selection for Huntington’s disease. This is a monogenetic debilitating disease without cure, leading to death in early middle age, and thus is a likely candidate for preimplantation genetic diagnosis. People possibly affected with the Huntington gene do not (...) always want to know their genetic status themselves, which is very burdensome knowledge. For prospective parents, this creates a difficulty in having unaffected children through embryo selection without knowing their own genetic status. A solution is provided by the exclusion test: it allows embryo selection while honouring the parents’ right not to know. The Dutch government however disallowed the exclusion test and chose to allow PGD on Huntington only for parents who test themselves first. To avoid “unnecessary” in-vitro fertilisation procedures for unaffected parents, prospective parents are “forced to know” before they can conceive through embryo selection. This article analyses the scope of the right not to know in the context of embryo selection against Huntington’s disease. It concludes that the right not to know implies that PGD against Huntington should be allowed by means of the exclusion test. (shrink)
